1.Conclusion of the contract and delivery of the products

1.1 Every order placed on www.bimoritaly.com implies the conclusion of a sales contract in Italian or English. When the order concerns a BiMOR ITALY Product, a single contract is concluded between the buyer and BIMORE Srl, P.zza Dante 23r, 16121 Genoa, VAT number / CF 02608300998,

1.2 By clicking on the "Buy" button the customer places a binding order for the items contained in the virtual cart. Once the order has been sent, a BIMORE Srl employee will send the customer an order confirmation email within 48 hours. The sales contract is considered concluded between BIMORE Srl and the customer when the latter receives the order confirmation. If the customer does not receive any order confirmation within the deadline indicated in this art. 1.2., the relevant order must be considered rejected by BIMORE Srl and, therefore, ineffective.

Orders in relation to which the customer has opted for advance payment will be shipped as soon as BIMORE Srl receives the total payment of the purchase price and any shipping costs. BIMORE Srl therefore invites the customer to pay the price as soon as the order confirmation is received and in any case within the following 7 days.

1.3 Where the products covered by the order are not available for reasons beyond the control of BIMORE Srl, the latter must promptly notify the customer. In this case, there will be no obligation for BIMORE Srl to deliver the goods ordered, except in the case in which BIMORE Srl has assumed the procurement risk in relation to the products forming the order in question.

In any case, if the ordered products are not available BIMORE Srl will refund, without any delay, to the customer any sum already paid.

1.4 BIMORE Srl does not assume responsibility for having to search for and find unavailable products from other sources. This provision also applies to orders relating to fungible goods (for which only the type and characteristics of the products are described). BIMORE Srl is only obliged to deliver what is available in stock and what is ordered from its suppliers. BIMORE Srl carries out deliveries exclusively in Italian territory and in some countries located in the EU and non-EU areas. If the delivery time is expressed in working days, all those between Monday and Friday included are considered as such, with the express exclusion of any public holidays.

2. Prices, shipping costs, express delivery and collection in boutiques

2.1 The customer is required to pay the price published on the product page when sending the order. The price indicated is final and includes VAT.

2.2 Shipping costs within Italian territory only are the responsibility of the customer, unless otherwise communicated during checkout.

2.3 It is possible to collect your purchases directly in the ANDREA MORANDO boutiques located throughout the area or in the headquarters in Piazza Dante 23r.

2.4 The prices indicated include VAT but do not include shipping costs, customs costs, duties and any other amount charged to the recipient.

3.Payment

3.1 BIMORE Srl accepts various payment methods: credit card, bank transfer, PayPal, Google Pay, Apple Pay, American Express and cash on delivery. BIMORE Srl reserves the right to refuse certain payment methods and to request different payment methods for certain orders. The customer is responsible for any costs associated with the transaction.

3.2 In case of purchase made with credit card, the charge will be made when the order is shipped.

3.3 The buyer agrees to receive invoices and credits exclusively in electronic format.

4. Use of promotional vouchers

4.1 Promotional vouchers cannot be purchased, they are offered by BIMORE Srl as part of promotional campaigns and can be used for a limited period of validity.

4.2 Promotional vouchers can only be used once in relation to a single order, within the specified validity period. It is possible that the possibility of using promotional vouchers is excluded for the purchase of some products. Promotional vouchers cannot be used to purchase gift vouchers. The use of a promotional voucher may be subject to a minimum spend amount.

4.3 The value of the products purchased must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid via any of the accepted payment methods referred to in the previous art. 3. Promotional vouchers are not refundable in cash and no interest accrues on the credit they represent. Promotional vouchers will not be refunded if the buyer decides to return part or all of the products ordered.

4.4 Promotional vouchers cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided by BIMORE Srl, it is not possible to combine different promotional vouchers for the same order.

4.5 If during the order the customer has used a promotional voucher and if the overall value of the order - due to the customer's withdrawal - is less than the value of the promotional voucher, BIMORE Srl reserves the right as of now to invoice the original price of the goods that remain in the customer's possession.

4.6 The purchase of the Gift Card cannot be combined with other discount codes.

5. Right of withdrawal

The customer has the right to withdraw from any order concerning BiMOR ITALY Products, without providing any reason and with any declaration, provided that it is explicit, delivered via email to info@bimoritaly.com.

The size, color and model change is free for the first replacement, subsequently the shipping costs for further changes will be borne by the customer, while the return is the sole responsibility of the customer.

5.1 Information regarding the right of withdrawal (pursuant to art. 49, paragraph 1, letter (h) of Legislative Decree no. 206/2005 “Consumer Code”)

The customer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days starting from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day period starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the goods. last good.

To exercise the right of withdrawal, it is necessary to inform BIMORE Srl via email to info@bimoritaly.com of the decision to withdraw from this contract through any explicit declaration to this effect.

5.2 Effects of withdrawal

Following withdrawal from this contract, BIMORE Srl will refund all payments made by the buyer, excluding delivery costs, without undue delay and in any case no later than 14 days from the day on which BIMORE Srl is informed by the customer of the decision to exercise the right of withdrawal. These refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed. In any case, the customer will not incur any costs as a consequence of this reimbursement. The refund may be suspended until BIMORE Srl receives the returned products or until the customer demonstrates that such goods have been shipped, if earlier.

Products purchased from December 1st to December 24th can be returned free of charge until January 7th of the following year.

The products must be returned

correctly packaged in their original packaging, not ruined, damaged or dirty and equipped with all accessories, instructions for use and documentation;

equipped with the transport document (present in the original packaging), so as to allow BIMORE Srl to identify the customer (order number, name, surname and address);

without obvious signs of use, other than those compatible with carrying out a normal test of the article (they must not show traces of prolonged use or in any case exceeding the time necessary for a test and must not be in such a state as to not allow its resale).

If the returned product does not comply with the provisions of the previous paragraph, the withdrawal will not be effective.

6. Refunds

Invoices will be issued exclusively in electronic format.

6.1 Refunds are credited directly to the account or payment instrument used at the time of purchase.

8. Guarantee for defects and non-conformities of the products and additional information

8.1 The provisions of the Consumer Code regarding guarantees for defects and non-conformities of products apply to purchases made on bimoritaly.com. The customer will therefore be granted the rights referred to in the art. 130 of the Consumer Code and these rights must be exercised within the terms set out in the art. 132 of the same Consumer Code.

8.2 These GCS can be consulted on the website www.bimoritaly.com or www.bimoritaly.com and can be saved using the relevant browser command (usually, File -> Save as).

8.3 It is possible to archive the order details and download the GCS using the relevant browser command to save the order summary that appears in the last screen of the purchase process, or by waiting to receive the automatic order confirmation message which BIMORE Srl sends via email following completion of the order. This confirmation message includes the order details and the GCS of BIMORE Srl, and can easily be printed or saved using the functions made available by the email programs.

9. Applicable law

9.1 These GCS and sales contracts are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 regulates distance contracts - and by Legislative Decree 70 of 04/09/2003 regarding e-commerce) and must be interpreted in light of this.

9.2 For any dispute that may arise in connection with the GSC and/or sales contracts, customers may activate an extrajudicial dispute resolution procedure compliant with the requirements set out in the articles. 141 et seq. of the Consumer Code.
